These Terms of Service ("Terms") govern your access to and use of the website operated by Nova Velora ("we", "us", "our"), and any purchase you make through it. By visiting our site or placing an order, you agree to be bound by these Terms.

Please read them carefully. If you do not agree to these Terms, you should not use our site.

1. Eligibility

You must be at least the age of majority in your place of residence to use this site, or have the consent of a parent or guardian. You may not use our products for any illegal or unauthorised purpose, nor may you violate any laws applicable in your jurisdiction while using our services.

2. Products and availability

All products are subject to availability. We may limit the quantities of any product we offer, discontinue any product, or restrict sales to any person, region or jurisdiction, at any time and without notice.

We make every effort to display product colours and images accurately, but we cannot guarantee that your screen displays them faithfully. Minor variation between the images shown and the item received is not a defect.

3. Pricing and payment

All prices are listed in US Dollars (USD) unless a different currency is displayed for your region, and are subject to change without notice. For orders shipped to the United States, prices are inclusive of any US import duties and tariffs, which we pay on your behalf. For orders shipped elsewhere, import duties and taxes charged by the destination country are your responsibility, as set out in our Shipping Policy. Sales tax, GST or VAT is calculated and displayed at checkout where we are required to collect it.

Payment is taken at the time you place your order. By submitting payment details you warrant that you are authorised to use the payment method provided.

4. Accuracy of information

We work to keep the information on this site accurate and current, but occasional errors occur. If a product is listed with an incorrect price or description, we reserve the right to cancel any order placed for that product, whether or not the order has been confirmed and payment taken. Where payment has been taken, we will issue a full refund promptly.

5. Order acceptance and cancellation

Your order is an offer to purchase. We reserve the right to refuse or cancel any order at our discretion, including where we suspect fraud, where an order appears to be placed by a reseller or distributor, or where a pricing or stock error has occurred. If we cancel your order, we will notify you and refund you in full.

6. Your account

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

7. Prohibited uses

You may not use the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to infringe any intellectual property rights; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload viruses or malicious code; to scrape, spider or otherwise harvest data; to interfere with the security features of the site; or to spam, phish or pretext. We may terminate your access for breaching any of these prohibitions.

8. Intellectual property

All content on this site — including text, graphics, logos, product images, and the compilation of that content — is the property of Nova Velora or its licensors and is protected by applicable intellectual property law. You may not reproduce, distribute or create derivative works from it without our prior written permission.

9. User submissions

If you send us reviews, comments, suggestions or other material, you grant us a non-exclusive, royalty-free, perpetual licence to use, reproduce and publish it in any medium. You agree that your submissions will not violate any third-party right and will not contain unlawful, abusive or obscene material. We are under no obligation to publish, maintain or respond to submissions.

10. Third-party links and tools

Our site may contain links to third-party websites or make third-party tools available to you. We do not control and are not responsible for the content, accuracy or practices of those third parties. Any use of optional third-party tools is entirely at your own risk, subject to that provider's own terms.

11. Disclaimer and limitation of liability

Except as expressly stated in these Terms and to the maximum extent permitted by law, the site and our products are provided "as is" and "as available" without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, Nova Velora, its directors, employees and suppliers will not be liable for any indirect, incidental, special or consequential loss, including loss of profits or data, arising from your use of the site or any product purchased through it. Where liability cannot lawfully be excluded, our total liability is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price you paid.

Some US states do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, and in those states the exclusions above apply to you only to the extent permitted. Nothing in these Terms excludes, restricts or modifies any warranty, guarantee, right or remedy conferred on you by applicable federal or state consumer protection law, by the Australian Consumer Law, or by any other mandatory consumer protection law of your country of residence, which cannot lawfully be excluded or limited.

12. Indemnification

You agree to indemnify and hold harmless Nova Velora and its officers, employees and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or third-party right.

13. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force.

14. Termination

These Terms remain in effect unless and until terminated by either you or us. You may terminate by ceasing to use the site. We may terminate your access at any time, without notice, if we believe you have breached these Terms. Obligations incurred before termination survive it.

15. Governing law

Nova Velora is a business registered in New South Wales, Australia. These Terms are governed by the laws of New South Wales, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state.

If you are a consumer resident in the United States, this clause does not deprive you of the protection of any mandatory consumer protection law of your state of residence, and does not prevent you from bringing a claim in the courts of your own state where the law of that state gives you that right. The same applies to consumers resident in any other country whose local law confers that protection.

16. Changes to these Terms

We may update these Terms at any time by posting the revised version on this page. It is your responsibility to review them periodically. Continued use of the site after changes are posted constitutes acceptance of those changes.
